On April 5, 2024, prominent Thai political activist Netiwit Chotiphatphaisal attended a military draft selection in Samut Prakan, declaring a stance of civil disobedience against conscription, prepared to face legal consequences. His actions have since led to formal charges for avoiding conscription procedures, based on Thailand's 1954 Military Service Act.
Following his protest, a complaint was filed against him, and the Human Rights Lawyers Center formally requested a review of jurisdiction. On November 8, 2024, Netiwit appeared at Bang Pu Police Station in Samut Prakan to acknowledge charges, accompanied by friends and legal representation. Police cited his failure to report for the draft selection on May 9, despite receiving a summons from the district office. According to Section 45 of the Military Service Act, charges for evading conscription could proceed to court if proven.
During questioning, Netiwit denied all allegations and requested additional time to submit his written defense by December 2, 2024. He intends to provide an expert-supported defense. While not detained, Netiwit is scheduled to meet with the public prosecutor on December 3, when a decision on indictment is expected.
